Missouri: How to Buy Compliant Cannabis Packaging

In order for your cannabis packaging to be compliant in Missouri, the packaging must follow the rules outlined by the Missouri Department of Health and Senior Services. There are three main categories of regulations that must be followed:

(1) required language,
(2) design prohibitions, and
(3) technical requirements like child-resistance and opacity.

 

Required Language

The first requirement for packaging is that it is labeled “Marijuana” or “Marijuana Infused Product” in a font size as large as the largest other font size used on the package. Also, there must be a warning stating, “Warning: Cognitive and physical impairment may result from the use of Marijuana.” For good measure, the state rounds out its requirements for included text with a law that requires the total weight of the marijuana included in the package, in addition to all ingredients, producing facility name, and the “best if used” by date.

 

Lastly, there are a few prohibitions on language that can be included on the packaging. The packaging may not contain any claims about health benefits and may not contain anything obscuring the required language in this section.

Design Prohibitions

The rules in Missouri contain three prohibitions for the design of your marijuana packaging. It may not be packaged or labelled in a false or misleading manner. Additionally, it may not be packaged or labelled in any manner designed to cause confusion between a marijuana product and any product not containing marijuana. Essentially, you cannot model your design on an existing product in a different space than cannabis. Finally, packaging may not be designed to appeal to a minor which has been interpreted to prohibit images like cartoons.

Technical Requirements

Missouri has relatively strict rules regarding the required technical aspects of their packaging. First, the packaging must be opaque so that the product may not be seen from the outside. Additionally, the packaging must be re-sealable for multiple uses. Finally, it must be child resistant meaning that it must be significantly difficult for children under five (5) years of age to open but not normally difficult for adults to use properly.
